The Legal Advisory Service provides you with:

Up to 30 minutes of telephone consultation time per legal matter of a non-dispute nature, with a licensed Real Estate attorney. There is no limit as to the number of non-dispute matters eligible for consults as long as they pertain to different legal matters. Legal matters must pertain to the property listed on the Protection Plan.

Up to a 25% rate reduction off the normal and customary fees on any additional services that the member requests from the participating attorney.

The Dispute Resolution Service provides you with:

Guidelines in communicating your claim to the adverse party in a dispute arising out of the Real Estate transaction, including sample demand letters and self-help guidelines provided by an RERM Risk Manager.

Informal mediation services provided by an RERM Mediator to bring early resolution of most disputes.

Assistance in facilitating mediations, including identifying potential mediators or arbitrators, to comply with the mediation/arbitration clause found in the typical Real Estate Purchase Agreements.

Information regarding the Small Claims Court system (when appropriate) when other remedies have not resolved the dispute.

The Dispute Resolution Service is limited to matters involving Buyers, Sellers & third parties only, who were involved in the transaction.

Note: Real Estate Risk Management’s staff of Risk Managers and Mediators, who are NOT attorneys, provides all Dispute Resolution Services.

Comprehensive Plan: This plan is a combination of Risk Management Services for the Real Estate Broker, Agent, Buyer & Seller. The special reduced rate is achieved by placing this service on every closed escrow. If service is needed prior to the close of escrow, it can be paid for by credit card or check. All of the above services are exclusively for legal matters pertaining to the Real Estate transaction registered on the certificate. Services will be provided immediately from the receipt of the certificate and payment.

Important Disclosures:

The Real Estate Agent, through whom this service is being provided, is enrolled in Real Estate Risk Managements Risk Management Plan. A portion of the fee paid for this Real Estate Buyers Protection Plan may be paid to the Real Estate Agent (or Broker) for their efforts in promoting an alternative dispute resolution services. The benefits provided under this plan attempt to discourage expensive litigation and to promote the use of other dispute resolution alternatives. If a dispute arises between you and your Real Estate Broker or Agent, you may contact us directly or your Agent or Broker. Your rights to seek your own legal representation or independent legal counsel outside of this plan to try to resolve the matter have not been waived.
